01Acceptance of these terms

These Terms of Use ("Terms") govern your access to and use of the PassStamp mobile application and any related content and services (together, the "App"), provided by Ingenio Productions ("we," "us," or "our"). By downloading, installing, or using the App, you agree to these Terms and to our Privacy Policy, which is incorporated here by reference. If you are using the App on behalf of an organization, you represent that you are authorized to accept these Terms on its behalf.

02Eligibility

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the App. The App is intended for engineering professionals and students preparing for licensure exams. By using the App, you represent that you meet these requirements.

03License to use the App

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to download and use the App on devices you own or control, for your own personal, non-commercial exam preparation. This license is provided to you under the terms applicable to apps distributed through the store you downloaded from - the Apple App Store, including the Apple Licensed Application End User License Agreement (EULA), or Google Play, including the Google Play Terms of Service.

04Purchases & content unlocks

PassStamp offers content packs and features that you can unlock through one-time, in-app purchases. These purchases are not auto-renewing subscriptions - once you buy a content unlock, it does not recur or require ongoing payment.

• Payment. All purchases are processed by the store you downloaded PassStamp from - the Apple App Store or Google Play - using that store account. Prices are shown in the App before you confirm, and applicable taxes may apply.
• Entitlements. We use RevenueCat to validate purchases and manage what you've unlocked. Your unlocks are tied to the store account you bought them with. PassStamp has no account of its own to attach them to.
• Restoring purchases. If you reinstall the App or use a new device, you can use the "Restore Purchases" option to recover content you've already bought, at no additional charge.

05Content & availability

We continually add and improve content. Every exam listed in the App is available to buy and sit; we do not list exams that are not finished. We may add, change, or remove content and features over time. We aim to keep the App available and accurate, but we do not guarantee that any particular content will remain available or uninterrupted.

06No accounts

PassStamp has no user accounts and no sign-in. You do not create a profile, choose a password, or connect an Apple or Google identity to use the App, and we do not offer a way to do so. Your unlocks are held by the app store you bought them from and are recovered with "Restore Purchases," so there is no account to secure, share, or lose. What the App does and does not collect is described in our Privacy Policy.

07Acceptable use

You agree not to:

• copy, reproduce, distribute, publicly display, or resell any content from the App except as expressly permitted;
• reverse engineer, decompile, or attempt to extract the source code or question bank, except where this restriction is prohibited by law;
• use automated means (such as scrapers or bots) to access or collect content from the App;
• circumvent, disable, or interfere with any security, entitlement, or purchase-verification mechanism;
• use the App to violate any law or the rights of others, or in any way that disrupts or harms the App or other users.

08Intellectual property

The App and its content - including questions, explanations, figures, text, design, graphics, and software - are owned by Ingenio Productions or its licensors and are protected by copyright, trademark, and other laws. "PassStamp" and our logos are our trademarks. Except for the limited license granted above, these Terms do not transfer any ownership or rights in the App to you.

"NCEES," "PE," "FE," and related exam names are referenced for identification only. PassStamp is an independent study aid and is not affiliated with, endorsed by, or sponsored by NCEES or any licensing board.

09Educational use & no guarantee of results

PassStamp is a study and practice tool. While we work to make our content accurate and representative of exam topics, the App is provided for educational purposes only. We do not guarantee any particular exam result, score, or outcome, and the App is not a substitute for official NCEES materials, professional instruction, or your own judgment. Practice questions and content are not actual exam questions.

10Third-party services

The App relies on third-party services - including the Apple App Store, Google Play, RevenueCat, and Google Firebase - each of which has its own terms and policies. Your use of those services through the App is also subject to their terms. We are not responsible for third-party services we do not control.

11Disclaimer of warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT CONTENT WILL BE ACCURATE OR COMPLETE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

12Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INGENIO PRODUCTIONS AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE APP WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US (IF ANY) IN THE TWELVE MONTHS BEFORE THE CLAIM, OR USD $50. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

13Indemnification

You agree to indemnify and hold harmless Ingenio Productions and its affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your misuse of the App or your violation of these Terms or applicable law.

14Termination

You may stop using the App at any time and uninstall it. We may suspend or terminate your access to the App if you violate these Terms or if necessary to protect the App or other users. Provisions that by their nature should survive termination - including intellectual property, disclaimers, limitation of liability, and indemnification - will survive.

15Changes to these terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above, and for material changes we will provide a more prominent notice within the App or by other appropriate means. Your continued use of the App after an update means you accept the revised Terms.

16Governing law

These Terms are governed by the laws of the United States and the State in which Ingenio Productions is established, without regard to conflict-of-laws principles. Nothing in these Terms limits any mandatory consumer-protection rights you may have under the laws of your country of residence.

17Apple App Store terms

These Terms are between you and Ingenio Productions only, not with Apple. Apple is not responsible for the App or its content. To the extent of any conflict between these Terms and the Apple Licensed Application EULA regarding your use of the App on Apple devices, the Apple EULA governs that conflict. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
